Arizona House Bill 2298

On April 18, 2023, Arizona Governor Kattie Hobbs signed House Bill 2298 which requires all Home Owner Associations that regulated parking on public streets, and have CC&Rs recorded before 2015, to have a vote prior to June 30, 2025 for the purpose of determining if the membership wants the association to continue to regulate their “no parking on the street” rules.  These rules apply to private cars, trucks, trailers, boats, and commercial vehicles.  Although gated sub-divisions are exempt from this legislation, the access roads to the sub-division may be impacted.  The outcome of this vote can potentially create political, compliance, safety, and financial concerns for the Vistoso Community Association (VCA). 

Rancho Vistoso is a planned community and the streets were designed with “no on street parking” and resident safety in mind.  Parking on these narrow streets could turn them into one-way roadways negatively impacting vehicular traffic and emergency fire and rescue response.  Enforcement of parking on these public streets is currently the responsibility of the VCA per our CC&Rs.

To meet the June 30, 2025 vote deadline, the VCA will include this parking topic as a separate line item in the March 2025 Board of Directors election packet.  Including this topic in the annual election packet will save the association approximately $25,000 in printing and mailing costs when compared to a separate mailing.
